Event Liability Waiver and Consent
Please read carefully before signing.
In consideration of being allowed to participate in the Dog Pool Event ("Event") and to bring my dog(s) onto City property and into the pool area, I acknowledge and agree as follows:
1. ASSUMPTION OF RISK
I understand that participation in this Event involves inherent risks to both people and dogs, including but not limited to slips, falls, dog bites, scratches, collisions, exposure to water and associated risks, and other injuries that may result from interactions with dogs, people, or the event location.
I voluntarily assume all risks associated with my participation and the participation of my dog(s) in the Event.
2. RELEASE OF LIABILITY
To the fullest extent permitted by law, I release and hold harmless the Friends of the Pocatello Animal Shelter and the City, and their officers, employees, agents, and volunteers ("Released Parties") from any and all claims, demands, damages, losses, liabilities, costs, or causes of action arising from or related to my participation or my dog's participation in the Event, including injury, illness, death, or property damage suffered by me, my family members or guests, or my dog(s).
This release applies to claims arising from ordinary negligence but does not apply to conduct that cannot legally be released under applicable law.
3. RESPONSIBILITY FOR MY DOG
I certify that my dog(s) are under my control and are suitable to participate in the Event. I understand that I am solely responsible for supervising and controlling my dog(s) at all times.
If my dog injures another person, another dog, or damages property, I agree to be fully responsible for all resulting costs, including medical expenses, veterinary expenses, property damage, legal expenses, and any other related damages.
4. INDEMNIFICATION
I agree to defend, indemnify, and hold harmless the Released Parties from any claims, demands, damages, losses, or expenses arising out of my participation in the Event or the actions of my dog(s).
5. EVENT RULES
I agree to comply with all Event rules and directions provided by Event staff. I understand that Friends of the Pocatello Animal Shelter or city workers or volunteers may remove me or my dog(s) from the Event at any time for safety reasons or failure to follow Event rules.
6. COLLECTION AND USE OF IMAGES AT EVENT
I acknowledge and understand that photographs, video recordings, and other media may be taken during the event by various individuals and organizations, including but not limited to Friends of the Pocatello Animal Shelter, City of Pocatello officials, employees, volunteers, event sponsors, media representatives, and other attendees. I grant Friends of the Pocatello Animal Shelter, the City of Pocatello, and their respective representatives, agents, successors, and assigns the unrestricted right and permission to use, reproduce, publish, distribute, display, and otherwise utilize any photographs, video recordings, or other images containing my likeness and/or the likeness of my dog(s) for lawful purposes, including but not limited to advertising, promotion, publicity, fundraising, educational materials, social media, websites, print publications, and future events.
I understand that I will receive no compensation for the use of such images and that I waive any right to inspect or approve the finished product or its specific use. I further release and hold harmless Friends of the Pocatello Animal Shelter, the City of Pocatello, and all authorized users of such images from any claims, demands, or liabilities arising from or related to the use of these photographs, videos, or other media.
